Business Insider Removes Josh Popkin Photo After Claim

Business Insider has removed a photograph of Josh Popkin from a 2020 article after he filed a copyright claim. Popkin sent the notice himself at 12:40 a.m. Eastern on October 1, 2026. At 11:08 a.m. the same day, 10 hours and 28 minutes later, the publisher's associate general counsel confirmed the image had been taken down. Business Insider said the use had been fair use and denied any liability. The photograph came down anyway. It is the second time in a month a major publisher has removed an image of Popkin after a copyright complaint, following BuzzFeed in September. Popkin, the founder of Position Strategy Group, called it a "W" and said the result matters beyond his own case.

What Did Business Insider Remove?

A photograph of Josh Popkin that illustrated a Business Insider article published on May 15, 2020, about a TikTok video filmed on the New York City subway and the public reaction to it. The image was a single frame taken from a video Popkin himself had published, which he owns. He had not licensed it to Business Insider or anyone else. The article remains online without the photograph; its own page data shows it was last modified on October 1, 2026.

How Did Josh Popkin Get the Photo Removed?

With one email. At 12:40 a.m. Eastern on October 1, 2026, Popkin sent Business Insider's legal department a formal notice under the Digital Millennium Copyright Act, citing 17 U.S.C. § 512(c)(3). It identified the article, stated that he owned and controlled the photograph, confirmed he had never granted permission, and asked for the image to be removed and the removal confirmed in writing. He wrote and sent it himself. No lawyer was involved.

How Long Did Business Insider Take to Respond?

Ten hours and twenty-eight minutes. The notice went out at 12:40 a.m. and the reply from Business Insider's associate general counsel arrived at 11:08 a.m. the same morning, confirming that the image had been removed. For a copyright claim against a national publisher, filed by one person without counsel, that is fast.

Did Business Insider Admit It Was Wrong?

No. Its counsel wrote that the use was permitted under the fair use doctrine, because the article was about a video Popkin published and the reaction to it, and the image was one frame of that video. The reply called it "quintessential fair use." It then said that "without an admission of liability," which the company "expressly denies," and "in the interest of resolving this matter," Business Insider had removed the image. The company reserved all rights and defenses. Popkin's position is simpler: the photograph is his, he did not consent, and it is down.

Is the Photograph Completely Gone?

From the article, yes. On October 1, Popkin replied that the same image still appeared as the article's thumbnail and asked for it to be removed there too. On October 5, counsel answered that any thumbnail or preview still showing was most likely served from a third-party or browser cache that Business Insider does not control, and that such previews update over time. As of October 5, 2026, that is where the matter stands.

What Can You Do if a Media Outlet Used Your Photo Without Permission?

Popkin's advice is not to assume you are powerless and not to give up. A photograph is protected by copyright from the moment it is taken, and United States law gives the rights holder a formal way to ask for its removal. The standard route, which is the one Popkin used:

  1. Confirm you own the copyright. The person who took the photograph, or filmed the video the frame came from, owns it unless the rights were transferred in writing.
  2. Save the evidence: the article URL, a dated screenshot and the image file.
  3. Find the publisher's designated copyright agent. The U.S. Copyright Office directory lists them.
  4. Send a written notice that identifies the photograph and where it appears, states that the use is unauthorized, includes a good-faith statement and a statement under penalty of perjury that you are the owner, and asks for written confirmation of removal.
  5. Keep every reply, with dates and times.
